On Eve of Trial, Ambrose Law Firm Attorney, Benjamin Koll, Gets Case Dismissed

Recently, Ambrose Law Firm Attorney, Benjamin Koll, obtained a dismissal on a Harassment Restraining Order (HRO) Violation case. This occurred on the eve of a jury trial. Previously, for the same client, Attorney Koll obtained acquittals for two assault charges and one disorderly conduct charge from a jury.

In some cases, prosecutors make reasonable offers, which tempt clients – and even lawyers – to strongly consider settling the case. In other cases, no reasonable offer is made, which makes the decision to go to trial a bit easier. And, in some limited circumstances, some cases should not be tried regardless of the plea offer. Defendants hold the sole decision whether to take a case to trial. It is a lawyer’s job to give them advice and talk to them about their options and back them regardless of the path they choose.

In Attorney Koll’s case, he previously won a jury trial for the same client, with the same prosecutor, in the same county. With the next case being on the eve of trial, the prosecutor dismissed the case. Sometimes, a case is set for trial with the sole tactic of trying to put pressure on the prosecution. Other times, clients legitimately want to take the case to trial. Building a reputation of trying cases and being successful certainly helps clients obtain excellent outcomes.

Here, Attorney Koll obtained acquittals and a dismissal of all assault and violent-related charges against his client. His client can breathe a giant sigh of relief knowing she does not have to appear in court again and move on with her life.
