Gross Misdemeanor Assault Expungements Granted
Recently, Attorney Robert Ambrose obtained expungements on two separate gross misdemeanor assault convictions in two separate Minnesota counties. Importantly, these were not expungements on stays of adjudications or continuances for dismissal. Expungements on cases with those resolutions are much easier to obtain. When a person is convicted of an offense, it is the petitioner’s burden to prove why they deserve the expungement. Obtaining expungements on domestic assault convictions is no easy task.
In one of the cases, which took place in Wright County, Minnesota, the prosecution objected to the expungement. Objections in expungement cases often cause judges to pause. They prefer to grant expungements when everyone is in agreement that the case should be expunged. Here, the judicial officer decided to rule in our favor. This did not occur simply because of the legal arguments made. The client did a fair amount of work to assist. He proved the mistakes from his early twenties were not at risk any longer. He showed lengthy and consistent sobriety, stable employment, and overall contributing to society. Mistakes from the past should not define a person’s future. Thankfully, Minnesota’s expungement laws allow people to obtain expungements, even on gross misdemeanor assault cases. In other states, expungements are not even available in many situations. Granted, it is not automatic that a domestic assault conviction will get expunged. They are difficult cases to win on expungements. However, strong legal and factual arguments can help put you in a better position to win.
