Attorney Robert Ambrose Obtains Complete Dismissals in Domestic Assault Cases
In the past two weeks, Attorney Robert Ambrose obtained complete dismissals in two domestic assault cases. In each case, the prosecutor agreed to dismiss all charges against each client well in advance of a trial date even being scheduled. Each client walked out the front door of the courthouse with their families with a smile on their face.
Domestic assault allegations are incredibly serious situations. Upon the initial allegation, the defendant is often arrested and taken to jail until they see a judge. If it happens over a weekend, they can sit in jail for multiple days waiting for bail and conditions of releaseto be set. In our situations above, each believed they were innocent. One on a basis of self-defense, the other stated an assault plainly never happened.
Unfortunately, domestic assault cases can end up in court merely based on a person’s word. If someone calls the police and describes an assault, then law enforcement may, and often does, pursue charges against an individual. For safety reasons, we all can see why arrests will happen. But every case is not so clear. Every case should not result in an arrest, charges, time in jail, a lengthy court process, and potentially trial. Thankfully, in the cases we had the past two weeks, the prosecution decided to drop all charges well before we even scheduled a trial. Saving everyone further time in the criminal justice system.
